How Long Does Workers’ Compensation Last In New Jersey?

The duration of workers’ compensation benefits in New Jersey varies depending on the type of disability:

  • Temporary total benefits: Temporary disability benefits are a partial wage replacement benefit. These benefits are payable when a doctor has determined you are unable to work and that inability to work lasts for more than seven days. Temporary disability benefits are paid at 70% of your average weekly wage up to a capped amount that changes year to year. Temporary disability benefits will cease after 400 weeks or when a doctor returns you to work or releases you from treatment;
  • Permanent partial benefits: Paid weekly based on the degree of functional loss after your temporary disability ends;
  • Permanent total benefits: Can be paid up to 450 weeks and potentially beyond if you remain totally disabled.  These benefits are also at a statutory rate up to 70% of your average weekly wage; and
  • Death benefits: Dependents may receive up to 70% of the deceased worker’s wage as well as up to $3,500 for funeral expenses.

Are There Cost of Living Adjustments with Workers’ Compensation Benefits in New Jersey?

Unfortunately, cost of living adjustments are only available for totally and permanently disabled workers and dependents of deceased workers whose injury or death occurred before January 1, 1980. For others receiving temporary total or partial total disability benefits, there are no statutory provisions for cost of living adjustments.
