What Is Social Security Disability?

Social Security Disability is an insurance-based program run by the federal government. American workers pay into this program by paying Social Security taxes, mostly through payroll deductions. You need to have paid enough Social Security taxes to earn sufficient “work credits” to be eligible to receive SSD payments.  You must also prove that you suffer a qualifying “disability”.

Important things to know about Social Security Disability:

  • Disability under the SSD program is defined as a condition that prevents you from doing substantial work for at least 12 months or until your death.
  • The SSA reviews your medical records to evaluate your Residual Functional Capacity, or what work tasks you are capable of performing.
  • There is a five-month waiting period from the date of your disability onset, with cash benefits becoming payable in the sixth month.
  • While the rules that govern SSD can seem complicated, our attorneys can help you access all the benefits you are entitled to.
